What is Hazardous Waste?

The EPA uses the term "hazardous waste" for chemicals that are regulated under the Resource, Conservation, and Recovery Act (RCRA).

The EPA uses the term "hazardous waste" for chemicals that are regulated under the Resource, Conservation, and Recovery Act (RCRA).

Solid Waste: EPA has specified at 40 CFR Part 261 a solid waste is hazardous if it is not excluded from regulation as a hazardous waste and meets any of the following conditions:

  • exhibits any of the characteristics of a hazardous waste
  • has been named as a hazardous waste and listed in the regulation
  • is a mixture containing a listed hazardous waste and a nonhazardous solid waste
  • is a waste derived from the treatment, storage, or disposal of listed hazardous waste
