36-8. General Requirements.

Clean-up and Corrective Operations

Operations involving clean-up, investigations, or corrective actions must comply with 29 CFR 1910.120 or 29 CFR 1926.65, excluding sections (p) and (q).

RCRA TSD Facility Operation

Organizations operating RCRA TSD facilities must adhere to 29 CFR 1910.120(p) or 29 CFR 1926.65(p).

Hazardous Materials Emergency Response

Organizations must plan and execute HAZMAT spill responses based on their HazCom Program, site-specific Emergency Action Plan in 29 CFR 1910.38, and comply with 29 CFR 1910.120(q) or 29 CFR 1926.65(q).

Employee Engagement in Emergency Response

Employees engaged in emergency response operations must follow 29 CFR 1910.120(q) or 29 CFR 1926.65(q) for hazardous substance release and response.

Munitions and Explosives of Concern (MEC)

Treat all encountered or suspected MECs as extremely dangerous and implement the 3R's: Recognize, Retreat, Report.
Follow the requirements outlined in EM 385-1-97 for suspected or encountered MEC.

36-8. General Requirements.

a.  Clean-up operations, investigations, corrective actions, voluntary clean-up operations involving employee exposure or reasonable possibility of employee exposure to safety and health hazards are required to comply with all sections of 29 CFR 1910.120 or 29 CFR 1926.65 except for sections (p) and (q) and all of parts of this chapter except for paragraph 36-7.c.  (36-8.a)

b.  RCRA TSD Facility Operation.  Organizations operating RCRA TSD facilities are required to comply with 29 CFR 1910.120(p) or 29 CFR1926.65(p).  (36-8.b)

c.  Hazardous Materials (HAZMAT) Spill Emergency Response Operations. Organizations responsible for performing HAZMAT spill emergency response operations must plan and perform responses according to their written HazCom Program (see chapter 6), site specific Emergency Action Plan in 29 CFR 1910.38, and meet the applicable requirements of 29 CFR 1910.120(q) or 29 CFR 1926.65(q).

d. When employees will be engaged in emergency response operations, they must do so according to 29 CFR 1910.120 (q) or 29 CFR 1926.65(q) when a hazardous substance release and response activities may result in exposure causing adverse effects to the health or safety of employees.  (36-8.d)

e.  Munitions and Explosives of Concern (MEC).  MECs can be UXOs, discarded military munitions or munitions constituents.  Treat all MEC encountered or suspected MEC as extremely dangerous.  Implement the 3R’s when encountering MEC: Recognize, Retreat, Report.  If MEC is suspected or encountered follow the requirements according to EM 385-1-97.  (36-8.e)
