36-8. General Requirements.

Clean-up and Corrective Operations

  • Operations involving clean-up, investigations, or corrective actions must comply with 29 CFR 1910.120 or 29 CFR 1926.65, excluding sections (p) and (q).
  • Follow all applicable parts of the chapter except for paragraph 36-7.c.

RCRA TSD Facility Operation

  • Organizations operating RCRA TSD facilities must adhere to 29 CFR 1910.120(p) or 29 CFR 1926.65(p).

Hazardous Materials Emergency Response

  • Organizations must plan and execute HAZMAT spill responses based on their HazCom Program, site-specific Emergency Action Plan in 29 CFR 1910.38, and comply with 29 CFR 1910.120(q) or 29 CFR 1926.65(q).

Employee Engagement in Emergency Response

  • Employees engaged in emergency response operations must follow 29 CFR 1910.120(q) or 29 CFR 1926.65(q) for hazardous substance release and response.

Munitions and Explosives of Concern (MEC)

  • Treat all encountered or suspected MECs as extremely dangerous and implement the 3R's: Recognize, Retreat, Report.
  • Follow the requirements outlined in EM 385-1-97 for suspected or encountered MEC.
